ABA e-learning – Trust & Estate law

elearningThe American Bar Association (ABA), Section on Real Property, Trust & Estate Law, is running its first professional development series through e-learning.

“Those undertaking the program will learn substantive legal and ethics issues – as well as best practices – from leading industry professionals with in-depth knowledge and hands-on experience in Trust & Estate Law.”

The program consists of ten 60-minute eLearning sessions, and attendees can register for the entire series or individual sessions.

Series registrants who register now (the program began on January 9) can receive registration for all remaining sessions and recordings of the sessions that have already occurred.

The Program

  • Estate Planning – Data collection, drafting documents and witnessing documents.
  • Trust Funding – Funding trusts, review of popular methods of probate avoidance methods (TOD and TOD funding of trusts, primer on jointly held property, beneficiary designations, etc.).
  • Estate Administration Part I (Legal Aspects) – Pre-appointment issues, appointment of a fiduciary, steps to take post-appointment including collection of assets and payment of claims, distributions, basic fiduciary accounting concepts and closing the estate.
  • Estate Administration Part II – Pre-appointment issues, appointment of a fiduciary, steps to take post-appointment including collection of assets and payment of claims, distributions, basic fiduciary accounting concepts and closing the estate.
  • Transfer Tax Issues – Overview of estate and gift tax with an eye on preparation of federal estate tax returns and federal gift tax returns.
  • Income Tax of Trust & Estates – Nuts and bolts of Subchapter J including differences between tax accounting and fiduciary accounting.
  • Specific Assets in Planning & Administration – Discussion of entities, retirement accounts, life insurance, real estate, and specialized trusts.

Best Practices
Review of ethical issues and estate planning documents for mistakes (including inadvertent inclusion issues raised by retained powers or powers given to beneficiaries, income tax risk to parents who have the right to use trust assets to satisfy a legal obligation, etc).
